TERMS AND CONDITIONS – EZYLIBRARY

These Terms and Conditions (“Terms”) govern access to and use of the EzyLibrary platform (“Platform”). By accessing or using the Platform, you agree to be legally bound by these Terms. If you do not agree, you must not use the Platform.


1. OPERATOR AND NATURE OF SERVICE

EzyLibrary is operated under the trade name “EzyLibrary” and provides software-as-a-service (SaaS) solutions to library and self-study center owners.

EzyLibrary acts only as a technology service provider. It does not own, manage, control, or operate any physical library, study center, or institution, and does not supervise students or staff.

Nothing in these Terms creates any partnership, agency, employment, or joint venture relationship between EzyLibrary and any user.


2. ELIGIBILITY AND USER ROLE

The Platform is intended solely for institution owners or authorized administrators.
Students do not receive independent user accounts. Any limited access provided to students is entirely controlled by the institution owner and is the sole responsibility of the owner.


3. SCOPE OF SERVICES

EzyLibrary provides digital tools including, but not limited to:

  • Student record management
  • Desk, shift, and locker allocation
  • Attendance tracking
  • Fee and expense records
  • Reports and administrative tools

Features may vary by subscription plan. EzyLibrary reserves the right to modify, add, suspend, or discontinue features at any time without liability.

EzyLibrary does not verify, validate, audit, or guarantee the accuracy of any data entered by users.


4. SUBSCRIPTION, PAYMENT, AND RENEWAL

Services are provided on a subscription basis through online payment methods.

  • Subscription fees are payable in advance.
  • Free trials, if offered, are for evaluation purposes only.
  • Fees once paid are non-refundable, Please Refer our Refund Cancellation Policy.
  • Subscriptions must be renewed before expiry to avoid service interruption.
  • Access may be restricted or suspended after subscription expiry.

5. DATA OWNERSHIP AND DATA PROTECTION

All data uploaded or generated on the Platform, including student information, attendance data, photos, device details, and records (“User Data”), remains under the ownership and control of the institution owner.

  • The institution owner is the Data Fiduciary.
  • EzyLibrary acts solely as a Data Processor under applicable data protection laws, including the Digital Personal Data Protection Act, 2023.
  • Institution owners are solely responsible for lawful data collection, consent, accuracy, storage, and compliance.

EzyLibrary does not independently verify User Data.


6. ATTENDANCE, DEVICES, AND NETWORK USE

Attendance features may involve IP address detection, approximate location data, device identifiers, and optional photographs, where enabled by the institution owner.

These features are optional. The institution owner is solely responsible for obtaining all required consents from students.

EzyLibrary is not responsible for:

  • Proxy or incorrect attendance
  • Network failures
  • Wi-Fi misuse
  • Device manipulation
  • Local infrastructure or router configuration

7. ACCOUNT SECURITY

Institution owners are responsible for maintaining the confidentiality of login credentials and account access.

EzyLibrary is not liable for data loss, misuse, or unauthorized activity resulting from:

  • Password sharing
  • Use of shared or public devices
  • Failure to log out
  • Negligence by owners, staff, or students

All actions performed through an account are deemed authorized by the institution owner.


8. PROHIBITED USE

Users must not:

  • Share accounts with unauthorized persons
  • Resell or commercially exploit the Platform
  • Reverse engineer or tamper with the system
  • Use one subscription for multiple institutions
  • Use the Platform for unlawful or fraudulent purposes

Violation may result in suspension or termination without refund.


9. AVAILABILITY AND NO WARRANTY

The Platform is provided “as is” and “as available”.

EzyLibrary makes no warranties, express or implied, including fitness for a particular purpose or uninterrupted availability. Downtime may occur due to maintenance, upgrades, cyber incidents, force majeure events, or factors beyond reasonable control.


10. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • EzyLibrary shall not be liable for indirect, incidental, special, or consequential damages, including loss of data, revenue, business, or reputation.
  • Total liability, if any, shall be limited to the subscription fees paid by the user for the relevant billing period.

This limitation applies even if EzyLibrary has been advised of the possibility of such damages.


11. INDEMNIFICATION

Users agree to indemnify and hold harmless EzyLibrary from all claims, losses, damages, penalties, and legal expenses arising from:

  • Misuse of the Platform
  • Violation of these Terms
  • Unlawful data handling
  • Student or staff disputes
  • Attendance inaccuracies
  • Network misuse

12. SUSPENSION AND TERMINATION

EzyLibrary may suspend or terminate access upon notice in cases of:

  • Violation of these Terms
  • Non-payment
  • Fraud or misuse
  • Legal or regulatory requirements

Upon termination, all access rights immediately cease. Termination does not create any refund obligation.


13. FORCE MAJEURE

EzyLibrary shall not be liable for failure or delay in performance due to events beyond reasonable control, including natural disasters, government actions, internet outages, or cyber incidents.


14. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of India.
All disputes shall be subject to the exclusive jurisdiction of the courts of Gaya, Bihar, India.


15. UPDATES TO TERMS

EzyLibrary may update these Terms from time to time. Continued use of the Platform constitutes acceptance of the revised Terms. Material changes may be notified via the Platform or email where feasible.

17. Severability
If any part of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

18. Data Deletion and Erasure

Institution owners and authorized representatives may request deletion or permanent anonymization of personal data stored on the Platform. Upon receipt of a valid deletion request, EzyLibrary will process such requests in accordance with applicable law, including the Digital Personal Data Protection Act, 2023, and delete or permanently anonymize the relevant personal data from active systems within a reasonable timeframe, subject to legal, accounting, and security obligations.

Certain logs, backups, or records may be retained solely for compliance, audit, or security purposes and will not be used for operational purposes. To request deletion of personal data, institution owners may contact management@ezylibrary.in. Students must make data deletion requests through their respective institution owner.
